Byers v. Byers, 10/21/14
April 20, 2017

In a dissolution of marriage, the trial court’s ruling granting the wife a nominal award of $1 in permanent periodic alimony was supported by clear and convincing evidence after a consideration of the factors set forth in ? 61.08, Fla. Stat. because the husband had filed bankruptcy, was currently working in a job paying far less than his prior bank positions, and his financial position was likely to change in the future. The trial court did not err by adopting the wife’s proposed final order because it appeared to reflect the court’s rulings. The trial court had sufficient evidence from which to conclude that the husband’s bonus checks should be included in the marital estate. The judgment of the trial court was affirmed.
