HCA Health Services of Florida v. CyberKnife Center of the Treasure Coast, 6/29/16
April 20, 2017

The trial court erred in granting lost revenue damages to an equipment supplier in its breach of contract action against a hospital arising from the hospital’s termination of the parties’ agreement. As lost profits was the correct measure of expectation damages because as lost the agreement was not just merely a lease as services were also provided thereunder. The supplier failed to provide proof at trial regarding those damages, therefore, judgment should have been entered for the hospital. The lower court?s judgment was reversed, and the matter was remanded for entry of judgment in favor of the hospital.
