Neiditch v. Neiditch, 3/18/16
April 20, 2017

There was competent, substantial evidence as to the factual basis for classifying $15,000 of the former wife’s Thrift Savings Plans (TSP) as a nonmarital asset. With regard to the loans from former wife’s TSP, the trial court committed an accounting error that required correction. It was error to include both the gross value and the negative net value of the husband’s vehicle as assets of the former husband. The trial court’s calculation of an equalization payment the former husband was required to make was incorrect. The lower court?s ruling was affirmed in part, reversed in part, and remanded for re-trial (with instructions).
