Storey v. Storey, 6/1/16
April 20, 2017

The trial court erred in reaching its conclusion that the former wife was entitled to the benefit of the former husband’s wage and other increases earned after the date the complaint for dissolution was filed, as well as survivor benefits. The martial settlement agreement’s (MSA) unambiguous language led the court to conclude that the parties expressly excluded any salary and cost of living increases the former husband received after the date the complaint for dissolution was filed from the former wife’s pension benefit calculation, and the MSA made no provision at all for survivor benefits. The lower court?s order was reversed. The case was remanded for entry of amended qualified domestic relations order.
